Hours of Service Lawsfrom a Missouri Truck Wreck Lawyer
As any Missouri Truck Accident Attorney can tell you, the Federal Motor Carrier Safety Administrations has established a number of regulations that cover many aspects of commercial motor vehicle operation. One of the most important aspects governed by the FCMSA is how many hours a truck driver can be one the road. These laws are referred to as hours of service regulations. These laws regulate how long a truck driver may drive and also be on-duty during a specific time period. The laws also require a minimum off-duty period before the truck driver can start driving again.
The Hours of Service laws main purpose is to stop wrecks caused by sleepy drivers, but if a truck collision has occurred, one should contact a Missouri Truck Accident Attorney right away. Alot of truck companies will go as far as to get rid of logs and evidence that prove that their driver surpassed the mandatory hours stipulated by law, since such a violation is recognized by most states as a reason for punitive damages.
In 1938, truck drivers were not allowed to drive more than twelve hours, no more than fifteen on-duty hours, followed by a minimum 9 hour rest period, and minimum duty cycles were not to exceed a total of 24 hours. In 1939, the laws were amended and driving hours were reduced to 10, with no limit on the number of consecutive hours a driver can be on-duty and a mandatory off duty time frame of at least 8 hours. The minimum duty cycle remained at 24 hours. These rules were further amended in 1962; a trucker was not to exceed a total of 10 driving hours and total on-duty hours were capped at 14. He or she was to receive a mandatory 8 hours off duty and a minimum duty cycle of 18 hours. As of 2003, with reference to property carrying vehicles, driving hours were set at 11, on duty hours at 14, and off duty at ten hours respectively. The minimum duty cycle was listed as 21 hours.
